Please be avised that, as the site is located within the Medium Density Residential Zone, the proposed use will require an impact assessable Material Change of Use application to be lodged with Council. Impact assessable applications include a minimum three week public notification period, where the application must be advertised within a local newspaper, signs must be erected on the subject land and adjoining landowners must be notified. This application will be assessed against the Hervey Bay City Planning Scheme in its entirety; however, some of the most relevant codes include:
* Urban Locality (Medium Density Residential Zone) Code;
* Commercial Use Code;
* Landscaping Code;
* Parking and Access Code;
* Urban Design Code;
* Works, Services and Infrastructure Code; and
* Airport Environs Overlay Code.

If you decide to lodge an application, you must provide the following:
* Completed IDAS Forms 1 and 5 (see attached);
* All mandatory supporting information identified on IDAS Form 5, including a site plan, floor plan and elevations and a statement describing the proposed development; and
* Application fee of $4992 (for the first 100m2 gross floor area), plus $545 for each 100m2 of gross floor area or part thereof in excess of 100m2.
Please note that infrastructure charges will also be payable upon commencement of the use.
Please note that Council’s draft regional Planning Scheme is currently undergoing its first State Interest Check. It is anticipated that this draft Scheme will be available for public consultation later this year. If you have any concerns regarding the zoning of the property, you will be able to provide submissions to Council during this time.
